On Saturday, Bay of Pigs invasion veterans mark 50 years since their release




















In the days before Christmas 50 years ago this weekend, 1,113 Bay of Pigs fighters captured by Fidel Castro’s forces and imprisoned for 20 months were finally released to a heroes’ welcome in Miami.

The first planeload of POWs arrived at Homestead Air Force Base on Dec. 23, 1962. Gaunt and betrayed by the John F. Kennedy administration, members of the proud Brigade 2506 were bused to Miami’s Dinner Key Auditorium, where waiting relatives engulfed them with hugs at a massive reunion that made front-page news. Five days later, JFK and his wife Jackie would be at the Orange Bowl to welcome them, too.

On Saturday, the 50th anniversary of those pivotal days will be observed as surviving brigade members — now in their 70s and 80s — hold a and 11 a.m. Mass and reunion at the Bay of Pigs Museum in Little Havana.





The release of the men was the one bright spot in the disastrous April 1961 CIA-backed invasion to overthrow the two-year old Castro government. Yet the fighters’ return also sent the somber message that exiles would not reclaim Cuba. The Cuban Missile Crisis that October had set the course of U.S.-Cuba relations until today.

Back then, it was sinking in: The Cuban exile community was in Miami to stay.

A defeated Jose Andreu, now 76, the first brigade member to sign up for the invasion, was among those who arrived home that bittersweet day.

“My wife to-be was there to meet me, along with my sister and my father,” Andreu said. “I remember a lot of hugging and crying.”

Among the young people waiting at the auditorium that day in 1962 was a teen-aged Ninoska Perez Castellon, there with her family to welcome her brothers and uncle, all brigade members.

“I remember being in that packed auditorium ... I can truly say as a child I viewed those men as my first heroes. I still do,” said Perez-Castellon, who grew up to become one of Miami’s most influential radio personalities.

Perez and her family still have black-and-white snapshots of the joyful reunion, showing her late grandmother proudly hugging her son.

The behind-the-scenes negotiations that finally led to the release of the brigadistas 50 years ago this week were the stuff of Hollywood movies. They involved months of haggling with Castro by everyone from a former first lady to a high-profile diplomatic negotiator who led the group that finally succeeded — a group of the prisoners’ mothers, wives and fathers who made up the Cuban Families Committee.

Their effort resulted in a now-forgotten 7,857 exodus of Cuban refugees, many relatives of the brigadistas, who arrived in cargo ships at Port Everglades in Fort Lauderdale from December 1962 to July 1963.

Two women in the committee played key roles — one in Cuba, motivated by a mother’s love; the other in Miami, seeking to free her husband.

Havana socialite, Berta Barreto, whose oldest son, Alberto Oms Barreto, had been captured during the invasion, made the initial contact with Castro and promised that the ransom he had set for the men would be paid. Years later, her second son, Pablo Perez-Cisneros Barreto, wrote the definitive book on the negotiations called After the Bay of Pigs, soon to be published in Spanish. “What my mother and the others managed to do, with no experience in high-level negotiating, was extraordinary,” Perez-Cisneros Barreto said.

2. Miss Universe 2012 Crowned

Beauties from 89 countries strutted their stuff Wednesday night in pursuit of the Miss Universe crown, but only one woman would earn the coveted title.

In the end a panel of ten celebrity judges, including Cee Lo Green and U.S. Olympic gold medalist Kerri Walsh Jennings, appointed Miss USA Olivia Culpo the winner.

The 20-year-old Rhode Island native beat out Miss Brazil (Gabriela Markus) Miss Philippines (Janine Tugonon), Miss Mexico (Irene SofĂ­a Esser Quintero), and Miss Australia (Renae Ayris) for the distinction.

Culpo follows in the footsteps of Miss Angola, Leila Lopes, who earned the crown in 2011.

The two-hour show was broadcast live from Las Vegas with musical acts One Direction and Train lending their talents to the annual extravaganza.

Homeland star Claire Danes and her husband Hugh Dancy welcomed their very first child together on Monday, December 17, her rep confirms to People Magazine.

The proud parents named their bouncing baby boy Cyrus Michael Christopher Dancy.

Danes, 33, wed Dancy, 37, in 2009 after two years of dating.

5. President Obama is Time's Person of the Year

For 2012, Time Magazine has selected President Barack Obama as their Person of the Year.

"For finding and forging a new majority, for turning weakness into opportunity and for seeking, amid great adversity, to create a more perfect union, Barack Obama is Time's 2012 Person of the Year," Time's Managing Editor Richzard Stengel explained.

He also cited both of the president's re-elections, snagging over 50 percent of the popular vote, as one reason he received this honor.

This is the second year Time has tapped Obama as their Person of the Year -- he previously was selected in 2008 for becoming the first black president of the United States.

Time previously named the eight finalists for 2012's Person of the Year. They included: Bill and Hillary Clinton, Apple CEO Tim Cook, Malala Yousafzai (the Pakistani girl who was shot by the Taliban for her crusade for better girls' education), Yahoo! Staten Island man killed in early-morning house fire

A Staten Island man was killed when an early-morning fire swept through his home, police and relatives said.

Jameek Champagne, 23, died in the third-floor attic of the home on Osgood Avenue in Clifton. His brother and grandfather escaped the blaze uninjured.

A neighbor reported the blaze after seeing flames erupt from the house at about 5:40 a.m. He banged on the door in a frantic effort to awaken its residents.

The fire was extinguished about an hour after it started, according to an FDNY spokesman. Fire marshals are investigating what caused it.

About ten cars full of grief-stricken relatives and friends came to the scene to mourn Champagne. His devastated girlfriend said that the two had a newborn girl and a 1-year-old boy.

Investors shuffling assets ahead of fiscal cliff




















Some citizens aren’t waiting to find out if the White House and Republicans in Congress will be able to reach a last-minute deal to pull the country away from the “fiscal cliff.”

They are selling securities while capital gains tax rates are still low or transferring millions into trusts for the benefit of children and grandchildren before estate tax laws become more stringent. Others are getting out of the markets and parking money in less risky accounts.

Miami financial planner Cathy Pareta has been counseling her upper middle class clients — “the Johnsons, not the Rockefellers” — on whether to adjust investment portfolios, accelerate income or realize capital gains sooner than planned.





“Some people are going to get hit hard,” said John Bacci, a financial planner in Linthicum, Md., who has gone down his client list and run projections on what higher taxes would look like for them. He’s looking at tax-friendly alternatives for some clients, such as annuities or rental property.

At year’s end, the country will leap off the “fiscal cliff” unless politicians reach a compromise on mandated spending cuts and the expiration of the Bush-era tax cuts.

For most investors, the expiring cuts will mean that the tax rate for long-term capital gains will rise from 15 percent to 20 percent. Dividends also will no longer be taxed at 15 percent but treated as ordinary income, which could mean a tax rate as high as 39.6 percent. And individuals with multimillion-dollar estates will find much more of their money subject to the federal estate tax.

Estate planning lawyers say the demand is so intense that they are putting in grueling hours to set up trusts.

“It’s very stressful. We are working day and night,” said Diana Zeydel, an estate planning lawyer with Greenberg Traurig in Miami. “Were doing three times what we normally do for end-of-the-year planning.”

Zeydel said many of her clients waited until after the elections in November to gauge how the political tide would affect their future finances. This gave them little more than a month to make major decisions about their wealth.

Most observing the political jousting in Washington expect taxes will go up even if the political leaders reach a deal — they’re just not sure how much. Many aren’t taking any chances.

Jim Ludwick, a financial planner in Odenton, Md., said one client in his late 50s cashed out stock and bond funds totaling $1.7 million not long after the election and stashed the proceeds in a money market fund.

The client, anticipating a market plunge due to the “fiscal cliff” and other issues, said he spent his entire working life building up a nest egg and wouldn’t have time to wait for his portfolio to recover, according to Ludwick. The client fears it won’t be safe to re-enter the stock market for another year.

“We have a number of clients who are taking capital gains this year, expecting that if they wait until next year, they will have to pay higher taxes on those same gains,” said Daniel McHugh, president of Lombard Securities in Baltimore. Some of those clients are realizing six-figure gains but are still willing to take the tax hit now, he said.

Of course, the downside is that the stock market could take off, and these investors will miss out on even higher gains, McHugh said. But, he added: “Given the state the economy is in, that’s a very small risk.”

Stand Your Ground motion denied in Janepsy Carballo case




















It will be up to a jury to decide if Janepsy Carballo was justified in the killing of the man she said killed her husband.

The Stand Your Ground motion filed by her defense was denied on Friday, based largely on Carballo’s inadvertent confession to a confidential informant who was wearing a police wire to investigate an unrelated drug charge at the pain management clinic where she worked.

Miami circuit court judge Beth Bloom said the tape of that conversation and the circumstances of the shooting “belied the claims” of forced entry and self-defense.





In 2008, Carballo shot Ilan Nissim six times in the back and arm one month after her husband and toddler son were shot in front of her house. Her son survived; her husband did not. Nissim was a suspect in the murder.

The controversial 2005 Stand Your Ground law eliminated a citizen’s duty to retreat when using lethal force to meet a threat of harm. The law also allowed judges greater leeway to dismiss a charge based on a self-defense claim.

The law came under scrutiny earlier this year when police initially declined to charge a self-proclaimed neighborhood watchman in the killing of Trayvon Martin in Sanford.

Carballo will go to trial in April facing murder charges.

Nokia, RIM settle old disputes in new patent pact






HELSINKI (AP) — Nokia Corp. and Canadian smartphone rival Research In Motion have agreed on a new patent licensing pact which will end all existing litigation between the two struggling companies, the Finnish firm said Friday.


The agreement includes a “one-time payment and on-going payments, all from RIM to Nokia,” Nokia said, but did not disclose “confidential” terms.






Last month, Nokia sued the Blackberry maker for breach of contract in Britain, the United States and Canada over cellular patents they agreed in 2003. RIM claimed the license — which covered patents on “standards-essential” technologies for mobile devices— should also have covered patents for non-essential parts, but the Arbitration Institute of Stockholm Chamber of Commerce ruled against RIM’s claims.


Major manufacturers of phones and wireless equipment are increasingly turning to patent litigation as they jockey for an edge to expand their share of the rapidly growing smartphone market.


Nokia is among leading patent holders in the wireless industry. It has already received a $ 565 million royalty payment from Apple Inc. to settle long-standing patent disputes and filed claims in the United States and Germany alleging that products from HTC Corp. and Viewsonic Corp. infringe a number of its patents.


The company says it has invested €45 billion ($ 60 billion) during the last 20 years in research and development and has one of the wireless industry’s largest IPR portfolios claiming some 10,000 patent families.


Nokia’s share price closed down 3.5 percent at €3.05 on the Helsinki Stock Exchange.

Oreo cookie maker Mondelez gives CEO $10M stock award








The company that makes Oreo cookies is sweetening the pay for its CEO with a special stock award valued at $10 million.

Mondelez Inc. says in a regulatory filing that the reward recognizes Irene Rosenfeld for "top-tier performance," including the recent "highly successful" spinoff of its Kraft Foods grocery business.

Mondelez, which also makes Cadbury chocolates and Trident gum, says the pay also is intended to give her incentive to continue delivering strong results. It includes restricted stock that will vest after three years and restricted stock based on the company's performance.

Miami-Dade jobless rate drops to 8.4 percent; Florida rate drops to 8.1 percent




















Florida’s unemployment rate dropped to 8.1 percent for November, down .4 percent over the previous month, bring it to November 2008 levels. It was the largest drop in month over month rates since October 1992, reported the state’s Department of Economic Opportunity.

In Miami-Dade County, the unemployment rate dropped to 8.4 percent when adjusted for seasonality; that represents a drop of .3 percent from October 2012 and 1.8 percent from November 2011.

In Broward County, the jobless rate dropped to. 7.0 percent, down .1 percent from October and down 1.8 percent from November 2011; seasonally adjusted numbers will not be released for Broward until later in the month.





Statewide, the total number of job postings increased sharply in November 2012 compared to the previous November by 29,522 (an increase of 12.4 percent), for a total of 267,310 openings (seasonally-adjusted), according to the Help Wanted OnLine data series from the Conference Board, Gov. Rick Scott’s office reported.

Broward County showed its first gain in construction jobs in 66 months. Miami-Dade continued to lose construction jobs for a 62th month.

Religious leaders, students in South Florida remember Newtown tragedy with observances




















South Florida religious leaders will be remembering the 20 children and six adults killed in the mass shooting at Sandy Hook Elementary School in Newtown, Conn.

On Friday, all Archdiocese of Miami schools will have a moment of prayer at 9:32 a.m. The archdiocese’s churches also will ring their bells 26 times in observance of those killed.

On Sunday, Temple Judea in Coral Gables will offer an interfaith service that will be open to everyone. Rabbi Edwin Goldberg said the idea was to offer a chance for the community to come together after what happened in Newtown.





“The point of the service is to come together and find comfort and hope,” Goldberg said.

Here are some of the observances:

•  Interfaith service organized by South Florida Muslim community, 2:30 p.m. Friday, Darul Uloom Institute, 7050 Pines Blvd. in Pembroke Pines.

•  Spiritual bouquet for Newtown students by the students of St. Rose of Lima in Miami Shores, prayer service at 10 a.m. Friday.

•  Prayer jar by students at Good Shepherd School in Southwest Miami-Dade to be sent to Newtown students.

•  Interfaith service, 4 p.m. Sunday, at Temple Judea, 5500 Granada Blvd. in Coral Gables.

Nintendo’s amazing triumph in Japan may doom the company internationally






According to Japanese gaming bible Famitsu, Nintendo (NTDOY) 3DS sold 333,000 units in the week ending December 16, while Sony’s (SNE) PS Vita limped along at 13,000 units, the new Wii U did an okay 130,000 units and the PlayStation 3 managed to sell 46,000 units.  The utter hardware domination of the 3DS is reshaping the Japanese software market. Franchises that were thought to be fading have been revitalized in their portable versions. The 3DS version of the ancient Animal Crossing series, famed for being the game where nothing happens, hit a staggering 1.7 million units last week in Japan. Inazuma Eleven sold 170,000 units in its launch week, up from 140,000 units its DS version managed in 2011.

Nintendo’s portable console 3DS had a muted start in its home market in the spring of 2011. Many thought that Sony would have a fair shot at competing with Nintendo once Playstation Vita launched at the end of 2011. But once Nintendo executed an aggressive price cut for 3DS in the summer of 2011 and then launched a large-screen version of the console in mid-2012, the gadget has grown into a Godzilla in Japan, demolishing both Sony Vita and aging tabletop console competition.

3DS is doing well also in America, where its lifetime sales are moving close to the 6 million unit mark this holiday season. According to NPD, the 3DS sales in the United States topped 500,000 units in November. That’s a decent number, though far from the torrid volume the portable is racking up in its home market. The U.S. November video game software chart was dominated by massive home console juggernauts: new installments of Call of Duty, Halo and Assassin’s Creed franchises shifted more than 13 million units in retail. At the same time, the Japanese software chart remains in a ’90s time warp, dominated by Nintendo’s musty masterpieces: Super Mario Brothers, Pokemon, Animal Crossing, etc.


Japanese and American tastes have always been different. But what we are witnessing now is a particularly fascinating divergence. American consumers are spending more of their time and money on smartphone and tablet games, while console game spending is increasingly focusing on massive, graphically stunning blockbuster titles on Xbox360 and PS3. The casual gamers are shifting to mobile games, while hardcore gamers remain attracted to sprawling epics on home consoles. The overall video game spending in America keeps declining month after month, as casual titles and mid-list games slide. But the Triple A whales like the Call of Duty series are doing better than ever.


In Japan, Nintendo has been able to battle back iPhone and Android game invasion with a nostalgic series of portable games that basically recycle the biggest hits of ’80s and early ’90s. Mario, Pokemons and other portable heroes are slowly losing their grip on U.S. and European consumers. But in Japan, some form of national nostalgia is keeping Nintendo on track.


The problem here is that the Japanese success of the 3DS may now be convincing Nintendo that it does not have to reconsider its business strategy. The smartphone and tablet game spending continues growing explosively across the world. Unlike console games, mobile game sales in China are legal. The global gaming spending is shifting towards new hardware platforms even as console mammoths like Halo still reign in America. At this critical juncture, Nintendo has managed to cocoon its home market in a web of nostalgia, turning the 3DS console and its Eighties left-over franchises into epic bestsellers yet again.


This means that there is no sense of urgency to push Nintendo into rethinking its long-term plans. The company may continue simply ignoring the smartphone and tablet challenge, designing new portable consoles and the 28th Mario game to support it. Twenty years ago, Japan’s insularity doomed its chances to succeed in the mobile phone business. And now the idiosyncratic nature of Japan may be leading its biggest entertainment industry success astray.

BMG nears $90M deal for Sony/ATV song catalog








BMG Rights is close to a deal for Sony/ATV’s Rosetta music publishing catalog, several sources told The Post.

One executive said the music publishing firm had offered around $90 million for the rights to some 30,000 songs.

Rosetta is packed with ’80s hits from acts such as Tears for Fears, Culture Club and Devo, along with British songstress Duffy’s “Mercy.”

Sony/ATV, a joint venture of Sony Music and the estate of Michael Jackson, agreed to sell the catalog to win European Union approval for its $2.2 billion purchase of EMI’s publishing arm.

BMG Rights is backed by German media giant Bertelsmann and private-equity firm KKR.

Carnival fourth-quarter profits tumble




















MIAMI (AP) – Cruise operator Carnival Corp. said Thursday that its fiscal fourth-quarter net income tumbled 57 percent, hurt by lower ticket prices and higher fuel costs.

Despite the drop, the results beat Wall Street predictions. But the Miami-based company issued a lower-than-expected profit prediction for the full year, and its shares fell 6 percent in morning trading.

Cruise line operators entered 2012 thinking they could start charging passengers more again after offering widespread discounts following the 2007-2009 recession. But just two weeks into the year, 32 people died when Carnival’s Costa Concordia sank off the coast of Italy. Bookings slumped even as cruise companies lowered prices.





For the quarter ended Nov. 30, Carnival earned $93 million, or 12 cents per share, down from $217 million, or 28 cents per share, in the same quarter last year. Excluding one-time items, the company, which operates Holland America Line, Princess Cruises and Carnival Cruise Lines, said it posted an adjusted profit of 13 cents per share.

Revenue fell 3 percent to $3.58 billion from $3.7 billion.

Analysts, on average, expected a profit of 11 cents per share on $3.49 billion in revenue, according to a FactSet poll.

Carnival’s revenue yields, which measure the amount a cruise company makes from its passengers after removing expenses, fell 4.5 percent, but were better than the 5 to 6 percent drop the company projected in September. In addition, fuel prices rose 5.4 percent to $716 per metric ton, but weren’t as high as the $739 per metric ton the company expected.

Those factors helped offset an increase in operating costs, resulting in the better-than-expected quarterly results, the company said.

For the full year, Carnival earned $1.3 billion, or $1.67 per share, down from $1.91 billion, or $2.42 per share, in the previous fiscal year. Revenue fell to $15.38 billion from $15.79 billion.

Carnival said that over the past six weeks, booking volumes for the first three quarters of this year were about the same as they were at the same time last year, with slightly lower prices. But overall advance bookings for 2013 continue to trail levels a year ago at slightly lower prices, the company said.

Carnival said it currently expects full year 2013 net revenue yields, excluding the effects of currency exchange rates, to rise between 1 and 2 percent. The yields are expected to decline 2 to 3 percent in the first quarter, but then improve sequentially during the rest of the year as ticket prices and occupancy for the North American brands and Costa recover.

Taking those expectations into account, Carnival projected an adjusted 2013 profit of $2.20 to $2.40 per share. Analysts had expected $2.47 per share.

The company also projected a fiscal first-quarter profit of 3 to 7 cents per share, while analysts expect a profit of 5 cents per share.

Carnival shares fell $2.15, or 6 percent, to $36.91 in morning trading.

New poll: Many Florida voters say they wouldn’t re-elect Scott as governor




















Gov. Rick Scott continues to suffer from poor approval ratings despite an improving economy and lowering unemployment, and a majority of voters say they wouldn’t vote to re-elect him, a new poll shows.

The poll found, among other things, that many voters are crediting the Obama administration with an improving economy, rather than Scott.

A Quinnipiac University poll released Wednesday showed Florida voters disapprove by 45-36 percent of the job Scott is doing, and 52 percent said he doesn’t deserve a second term, compared to just 30 percent who told pollsters Scott should be re-elected.





The poll also found that 55 percent of voters — including 53 percent of Republicans — say they’d like another Republican to challenge Scott for the GOP nomination in 2014.

Republican voters do give Scott a positive 63-19 percent job approval rating, however, and GOP voters say by a 55-26 percent margin that he deserves a second term.

“Obviously, the governor has almost two years to go until the election and anything is possible, but he faces a herculean task in changing public opinion to his favor,” said Quinnipiac pollster Peter Brown.

Scott, who has struggled with negative approval ratings since being elected in 2010, plans to seek re-election next year. The only declared candidate challenging him is Democratic former state Sen. Nan Rich. Former Republican Gov. Charlie Crist, who is now a Democrat, is considering a run, and Democrat Alex Sink, who narrowly lost to Scott in 2010, is thought to be mulling a rematch.

Crist, who was governor as a Republican from 2007 to 2011 and lost a bid as an independent in 2010 for the U.S. Senate, has a 47 percent favorable rating and 33 percent unfavorable mark among all voters, according to the Quinnipiac poll. His favorability among Democrats is 65 percent and among independents is 48 percent, but only 28 percent of Republicans have a favorable view of Crist, compared to 56 percent who have an unfavorable view.

Crist on Wednesday said he has no timetable for deciding whether to run for governor. Of Scott’s poor rating he said, “I would attribute the downturn to this voting issue,” meaning the election law Scott signed that is still controversial.

Asked what factors he would use to decide, he said: “I love my state and my heart bleeds for the people of Florida right now. I think we can do better with education in our state, with the environment in our state. …”

Sink overall is viewed favorably by just 27 percent of voters and unfavorably by 14 percent, but 57 percent of respondents didn’t have an opinion.

Among four other possible Democratic challengers the poll asked about — Rich, Orlando Mayor Buddy Dyer, former Tampa Mayor Pam Iorio and South Florida businessman and former lawmaker Jack Seiler — none has a favorability score of more than 17 percent and the overwhelming number of respondents said they didn’t know enough about them to have an opinion.

The only other Republican the pollsters tested was Agriculture Commissioner Adam Putnam, thought by many to be a likely candidate for governor in the future. But 80 percent of voters don’t have an opinion currently about Putnam, a longtime former Congressman and former state legislator.

Respondents said they dislike Scott’s policies by 52 percent to 32 percent, though nearly half of voters say they’re at least somewhat satisfied with the way things are going in Florida — the highest so far during Scott’s term. The poll didn’t ask specifically what policies voters don’t like.

Scott has staked his success on creating jobs, and has been able to boast about a falling unemployment rate for several months. Florida’s jobless rate fell in October to 8.5 percent, its lowest level since December 2008, and non-farm employment has grown for more than 27 straight months. When Scott got elected, unemployment in the state was at 12 percent, so he has made good to some degree on his main promise of getting people back to work.

Pollsters found, however, that many voters are crediting the Obama administration with the improving economy. Twenty-seven percent of respondents said the president deserves “a lot” of the credit for the improving economy, to just 16 percent who think Scott deserves “a lot” of the credit. Similarly, though, those voters who believe the economy is getting worse, overwhelmingly blame Obama rather than Scott.

The poll also found a 52-30 percent approval rating for U.S. Sen. Marco Rubio, a Republican, and a 51-31 percent approval rating for U.S. Sen. Bill Nelson, a Democrat. The Legislature, generically, is seen negatively by 44 percent of respondents with just 35 percent approving of lawmakers on the whole.

The poll included 1,261 registered voters and was taken Dec. 11-17. It has a margin of error of plus or minus 2.8 percentage points.

A video of a purported golden eagle swooping from the skies of Montreal to snatch a toddler off the ground flew its way across the internet this morning, instantly becoming a viral sensation.

But on closer review, the video, which has over one million views on YouTube already, is full of clues that might lead you to believe it is a fake.

The eagle-eyed viewers should notice the first clue in within seconds of the 1 minute video when the right wing of the bird appears to get cut in half only for it to reappear fully feathered an instant later.

Stone-crab season suffers in the Keys




















Despite rocketing prices for stone-crab claws, many Florida Keys commercial fishermen have nearly given up on the season only 2 months old.

"We may see record prices but also record pain," said Gary Graves, general manager of Keys Fisheries in Marathon. "Prices don't mean anything if you can't catch anything."

Harvests since shortly after the season opening Oct. 15 have been "as bad as I can remember during my 45 years in the business," Graves said. "It's just bleak."





Keys Fisheries, one of the state's leading wholesalers for stone crabs, has laid off half of its production staff, maybe 20 people, Graves said.

"We hate to do it to our people but we're probably not finished," he said. "Right now, a big day for us is 1,000 pounds [of claws]. It should be around 15,000 pounds. We're doing nothing."

Keys Fisheries has raised its dockside prices paid to fishermen several times to encourage fishermen to keep their traps in the water.

Graves said it costs a fisherman about $1,200 in fuel, labor and other expenses to make a day's trip. The fish house's current prices are $9 per pound for medium-size claws and $17 per pound for the coveted jumbos.

"Our wholesale sales prices are higher than that and retail is through the roof," Graves said. "But we can't fill the orders we have."

A Marathon community group recently canceled the organization's annual stone crab feast for members because no claws were to be found.

The season runs until May 15.

Last season, Monroe County produced about 1.1 million pounds of legal-size claws, accounting for a large portion of Florida's total 2.67 million-pound harvest worth an estimated $23.6 million to the commercial fleet.

About 1,000 people statewide are licensed to fish traps for stone crabs. Only the claws are kept. Historically, stone-crab harvests have topped three million pounds of claws.

"The last two years were good and the recruitment looked normal," Graves said. "The first round of trap pulling was fine but it went downhill from there — like falling off a cliff."

Fishermen and researchers are baffled.

"Blame it on global warming, blame it on BP [Deepwater Horizon oil spill], blame it on Mother Nature," Graves said. "Everybody's got an idea but nobody can say why. It's probably a combination of a bunch of things."

News reports from stone-crab fleets farther up the Florida Gulf Coast suggest an octopus population explosion. Crabs are a favorite food of octopus, which are smart enough to get into traps.

"We've seen more octopus in the 6- to 8-pound range, which is abnormal," Graves said. State experts have suggested warm winters may have triggered the octopus boom.

"Things could turn around," Graves said, "but realistically the chances of it happening this season are slim."

WWII vet to receive French Legion of Honor




















Hal Lobree was an 18-year-old radio operator with the U.S. Army’s 106th Infantry Division, less than three weeks into his deployment to war-ravaged Europe, when Adolf Hitler launched a surprise blitzkrieg that would later be known as the Battle of the Bulge.

From his post in a farmhouse cellar in the town of St. Vith, Belgium, Lobree frantically connected calls from the front to the various commanding officers. Each was more desperate, as the Germans encircled and cut off U.S. forces.

“They’re on top of us!”





“We’re outmanned!”

“I can see them coming!”

As the radio calls ceased and casualties began to mount — it turned into the bloodiest battle U.S. forces experienced during World War II, with 19,000 American dead — Lobree and three others from his regimen fell back into the woods. They hid there until they were rescued by a U.S. Army Corps of Engineer truck.

Lobree would spend the rest of the war with another Army outfit, the 28th Infantry Division, attached to Gen. George Patton’s Third Army, as it chased the Germans through northern France and into eastern Germany. Lobree never again saw any of the 106th Infantry guys who had trained with him in Indiana’s Camp Atterbury and then fought in the Ardennes, the dense forest and mountain region that extends through Belgium, Luxembourg and France.

“What saved my life was one thing – I was a switchboard operator,” he recalls with a rueful shake of the head.

Now, almost seven decades after those frigid, snowy December days in 1943, Lobree will be presented with the French Legion of Honor on Wednesday at a ceremony in Surfside, along with a handful of other South Florida World War II veterans. It’s not the only honor the 1943 graduate of Miami Beach High has received for his service during the war. He was also awarded the Bronze Star for Meritorious Achievement in Ground Operations Against the Enemy in 1948.

In what Lobree calls “a happy coincidence,” one of his sons, Shawn Lobree, a senior captain with the U.S. Navy, will receive an honor of his own. Within hours of the French Legion ceremony, on the deck of the U.S.S Peleliu somewhere in the Arabian Sea, the younger Lobree will be installed as Commodore of the Third Amphibious Squadron of the U.S. Navy, in charge of a fleet of ships.

“As that 18-year-old in the army 69 years ago, I would’ve never figured on something like this happening.”

The elder Lobree says he’s “very pleased, very proud” of his son’s 26-year Naval career. But he’s not surprised. Shawn, like his older brother H.Baird and his twin brother Shawl, were champion sailors in their youth, winning multiple Florida state titles and national championships.

Lobree loves talking about his children’s feats and only reluctantly talks about his own. The French Legion award prompted him to dig out photos and other memorabilia.

“See that?” he says, pointing to a black scrapbook. “It was gathering dust until all this happened.” In it are photos, magazine and newspaper clippings, calendars and ticket stubs that chronicle a long, eventful life.

After the war, Lobree attended the University of Texas on the G.I. bill and graduated to a job in the oil industry as a petroleum geologist in Indiana. There he married and had four children before moving back to his hometown 42 years ago.

Two of those children remain in Miami — daughter Fleur, a Miami-Dade County Court judge, and son H. Baird, a professional management and information technology consultant — and will attend the Dec. 19 ceremony. In February, Fleur Lobree will be elevated to the Eleventh Judicial Circuit by Gov. Rick Scott.

Jeannine, his wife of 51 years, died in July. “She would’ve loved seeing all this,” he says.

And though he appreciates the war honors, he also admits that dredging up the memories can be painful. “War changes you,” he says. “You’re never the same again.”

One wonders if Stewart wished her cinematic journey ended all those years ago, as her high profile status led to one of the most memorable celebrity scandals of 2012. And I apologize to everyone for making them so angry. It was not my intention."

In the end, Stewart says she learned a lot from that experience -- particularly not to let the public dictate decisions made in her personal life. "It's a little annoying having to be so compartmentalized," she says. "I go from box to box to box. But I'm going out a lot more now. I was starting to get closed off and self-conscious, and I'm trudging forth into the world more often."

Merry Christmas, America-Haters?






When TNT was preparing its annual special “Christmas in Washington” with the president of the United States, you’d think the last star musician they would consider to join the official caroling would be Psy, the South Korean rapper. What on Earth is Christmasy about this man’s invisible-horse-riding dance to his dorky disco-rap hit “Gangnam Style”? It’s not exactly the natural flip-side to “O Holy Night.” But TNT couldn’t resist this year’s YouTube sensation.


This inane publicity stunt backfired when the website Mediaite reported on Dec. 7 that Psy (real name: Park Jae-sang) had participated in a 2002 protest in which he crushed a model of an American tank with a microphone stand. But that’s nothing compared to the footage of a 2004 performance after a Korean missionary was slaughtered by Islamists in Iraq. These lyrics cannot be misunderstood.






“Kill those f—-ing Yankees who have been torturing Iraqi captives … Kill those f—-ing Yankees who ordered them to torture … Kill their daughters, mothers, daughters-in-law and fathers … Kill them all slowly and painfully.”


This isn’t just anti-American. It’s anti-human.


Guess where this story first surfaced in the American media? CNN, from the same corporate family tree as TNT. It was posted back on Oct. 6 on CNN’s iReport, an open-source online news feature that allows users to submit stories for CNN consideration.


The Korean one-hit wonder put out the usual abject careerist apology, but he weirdly said, “I’m deeply sorry for how these lyrics could be interpreted.” Those darn lyrics and those darn people who misinterpret lyrics about killing Yankees’ mothers. It is like Barack Obama expressing regret for the awful things said about Susan Rice, ignoring the awful things said by Susan Rice.


Psy is now a millionaire. As Jim Treacher wrote at the Daily Caller: “So far he’s made over $ 8 million from the song, about $ 3 million of it from the people he once wanted to kill.” Brad Schaeffer at Big Hollywood noted his own father fought for South Korea’s independence in the Korean War: “Had it not been for ‘f——-g Yankees’ like my Dad, this now-wealthy South Korean wouldn’t be ‘Oppan Gangnam Style’ so much as ‘Starving Pyongyang Style.’” (Gangnam is a posh district in the South Korean capital of Seoul.)


Despite the controversy, neither the Obama White House nor the TNT brass felt it was necessary to send Psy packing before the Dec. 9 taping. On Saturday, ABC reporter Muhammad Lila merely repeated, “the White House says the concert will go on and that President Obama will attend, saying that they have no control over who performs at that concert.”


What moral cowardice. On Monday morning, another pliant publicist, NBC correspondent Peter Alexander, calmly relayed that the White House did take control on the Psy front — on its own “We The People” website, where the people may post petitions to the president for their fellow citizens to sign. A petition asking Obama to dump Psy from the Christmas concert was itself dumped. Alexander explained: “But that petition was removed because the rules say the petitions only apply to federal actions. And, of course, the President had no say over who the private charity chose to invite.”


This is double baloney. The White House hasn’t removed silly “federal action” petitions like the one asking to “Nationalize the Twinkie Industry,” or one to “Secure resources and funding, and begin construction of a Death Star by 2016.” They removed one that they didn’t want people to sign.


As for Obama having “no say over” who appeared on the TNT show, the president could easily declare he wasn’t going to share a stage with this America-hater. Or he could have obviously placed one phone call to Time Warner CEO Jeff Bewkes (an Obama donor), and expressed the dismay of the President of the United States.


Instead, the Obamas came and honored Psy. Yes, the president honored a man who despised America enough to want its citizens slaughtered.


John Eggerton of Broadcasting and Cable magazine observed, “At the end of the taping, when the First Family customarily shakes hands and talks briefly with the performers, the First Lady gave Psy a hug, followed by a handshake from the President, who engaged Psy in a short, animated discussion — at one point Psy appeared to rock back with laughter — and patted the singer on the shoulder.”


I never thought I’d ever view a Christmas special featuring a hideous hater of America celebrated by the President of the United States.

Paula Broadwell online stalking probe dropped

The Justice Department is dropping its investigation into whether David Petraeus' mistress, Paula Broadwell, stalked a romantic rival online.

Broadwell's lawyer, Robert Muse, gave The Associated Press a letter from U.S. Attorney Robert O'Neill that says no federal charges will be brought in Florida related to "alleged acts of cyberstalking."

A retired general, Petraeus resigned as CIA director in November after acknowledging the extramarital affair, which was exposed after Broadwell emailed Tampa socialite Jill Kelley, allegedly warning Kelley to stay away from Petraeus and Gen. John Allen, the U.S. commander in Afghanistan.

Kelley reported the emails to the FBI, triggering an investigation that led the FBI to Kelley's emails to the married Allen, who is now under investigation by the Pentagon's inspector general.

Narcy Novack gets life in prison for killing her hotel heir husband




















An epic family murder saga ended Monday when Narcy Novack, wife of Fontainebleau hotel heir Ben Novack Jr., was sentenced to life in prison.

Three years after she and her brother Cristobal planned and helped execute Ben Novack and his mother Bernice, the convicted killers, who had remained loyal to each other throughout the trial, made it clear their family ties would not extend to prison. Cristobal also was sentenced to life in prison Monday.

Each blamed the other for masterminding the murders, and their lawyers each asked the judge for leniency, claiming they were less culpable because the other sibling was pulling the strings.





The former Hialeah stripper, 56, will now spend her days in a yellow prison jumpsuit and sneakers and sleep on a cot in a small jail cell. Known as a late riser, Novack will now be forced up at the crack of dawn each day to do chores, like washing floors and peeling potatoes.

Her new life will be far cry from her jet-setting days drinking champagne and having servants to do her cooking and cleaning.

But even more devastating is that with her conviction, Narcy Novack loses all rights to the bounty she hoped to claim with his death. While she was designated as the sole beneficiary of his estimated $10 million estate, under Florida’s Slayer Statute, she now forfeits all rights to his fortune.

Novack, and her brother, both natives of Ecuador, were convicted in June of plotting the July 12, 2009, killing of her husband, son of the late Ben Novack Sr., who built Miami Beach’s storied Fontainebleau hotel. Narcy Novack believed that her husband was going to leave her for another woman and that she would be left with a fraction of what she felt she was entitled.

Under Ben Novack Jr.’s will, his mother, had she lived, would have been appointed as curator of his estate and received $200,000 in cash plus $2,500 per month. Though Narcy Novack would receive the balance of her husband’s property and money, as curator, Bernice Novack would have exercised great control over the purse strings, and likely would have made life difficult for her daughter-in-law, whom she had once accused of trying to poison her.

The bloodshed began on April 5, 2009, when two hitmen hired by the siblings drove to Bernice Novack’s home, at 2737 NE 37th St. in Fort Lauderdale. One of the hitmen, Alejandro Garcia, said he hid next to Bernice Novack’s garage, near where her car was parked in the driveway. As it grew dark, Novack, clad in a nightgown, came out of her house and pulled her car into the garage. Garcia followed her inside, and as she began to step out of her vehicle he clubbed her on the head with a monkey wrench. As she screamed, he continued to beat her in the face.

“The plan was to hit her in the teeth and give her a good beating,” Garcia testified during trial.

Garcia then fled, leaving the Novack matriarch sprawled in the front seat of her car. She somehow managed to pull herself out of the vehicle and get inside her house where she tried to clean up the blood. But while trying to fix herself up, she collapsed and died in the laundry room. Her son found her body the next morning, drenched in blood. An autopsy showed that her teeth were broken, along with a finger, and that her skull was cracked. Both Fort Lauderdale police and the Broward Medical Examiner, however, ruled the death an accident, theorizing that she died from a fall.

Believing that they had gotten away with one murder, Narcy and her brother then focused on getting her husband out of the way. In addition to his $10 million estate, they intended to take control of his company, Convention Concepts Unlimited, which reportedly grossed $50 million a year.

On July 12, Garcia and another hired accomplice, Joel Gonzalez, were driven to Rye Brook, N.Y., a wealthy Manhattan suburb, where Ben Novack was organizing a business convention for his largest client, Amway International. That morning, after working most of the night, Ben Novack climbed into bed about 6:30 a.m. to get a few hours rest. Shortly before 7 a.m., Narcy Novack opened the door to their suite, and Garcia and Gonzalez entered. She

RIM begins BlackBerry 10 tests with business, government clients






TORONTO (Reuters) – Research In Motion Ltd said on Monday that it had begun a “beta testing” program that allows 120 companies and government departments to try out its new BlackBerry 10 smartphones before their global launch on January 30.


The Canadian company, which is trying to reverse a sharp decline in market share for the BlackBerry, said the program would enable so-called enterprise customers in business and government to size up the BB10.






Features of the BB10 include the ability to separate personal and business information so that the user can store both without compromising security.


RIM has struggled in recent years to hold on to its base of enterprise customers, which typically pay a higher subscription fee than consumers, as their employees push to use devices such as Apple Inc’s iPhone for business as well as personal communications.


“This is a crucial step for us in getting our large enterprise customers ready to support BlackBerry 10 at the point of launch date, as opposed to post-launch date,” Bryan Lee, senior director for enterprise accounts, said in a phone interview.


RIM is providing the software and handsets at no charge, and the companies do not have to buy anything once the trial is finished.


The company plans to release its quarterly results on Thursday, and analysts expect it to report its third straight loss as it struggles to sell its older devices.


RIM made its name selling mobile email devices to bankers, lawyers and other professionals before expanding to sell phones to consumers.


The company said the BB10 testers were from financial, insurance, healthcare, manufacturing, media, and distribution industries and include 64 Fortune 500 companies, as well as government departments.


Lee would not identify any of the entities, beyond Integris Health and the U.S. Immigration and Customs Enforcement agency, which have both said they are testing the new devices.


The customers have installed test versions of RIM’s new server software, which manages iPhones and devices using Google Inc’s Android software as well as BlackBerrys, and will each receive two preproduction BlackBerry 10 handsets later this week.


RIM shares were down 2.1 percent at C$ 13.59 in morning Toronto Stock Exchange trading.


The stock has rallied from September’s multiyear lows around C$ 6.50 on a wave of optimism over the new devices, but the share price is still far below mid-2008 highs of around C$ 150.

Fla. woman gets life in prison in family killings








A woman from Florida has been sentenced to life in prison in the killings of her millionaire husband and mother-in-law.

Narcy Novack of Fort Lauderdale was not in the White Plains courtroom to hear the sentence on Monday. She waived her right to appear, just as she did when the verdict was delivered in June.

Her brother and co-defendant, Cristobal Veliz of Brooklyn, was also sentenced to life in prison in federal court in White Plains.

They were convicted of hiring hit men to carry out the 2009 beating deaths of Ben Novack Jr. in New York and Bernice Novack in Florida. Ben Novack was the son of the man who built the Fontainebleau hotel in Miami Beach.

Ryder CEO Greg Swienton retiring, COO getting promoted




















Trucking giant Ryder will get a new CEO in two weeks, as the Miami-Dade company announces the retirement of Gregory Swienton and the promotion of current COO Robert Sanchez to the top job.

Ryder, which leases commercial trucks and manages supply operations for companies around the world, saw revenues and profits increase this year, but has also been cutting costs and selling part of its fleet to combat slowing sales. Swienton, 63, joined Ryder as president in 1999 and was promoted to CEO a year later. Sanchez, 47, will become the company’s fifth CEO since its founding in 1933 by a Miami Beach construction worker named Jim Ryder.

Sanchez becomes CEO on January 1, and Swienton will retain the title of chairman of the board until Ryder’s annual meeting in May, when that title will pass to Sanchez, too, the company said in a press release issued Monday morning.





A 19-year veteran at Ryder, Sanchez has served as head of the company’s largest division, global fleet management solutions, and as chief financial officer.

E. Follin Smith, an independent director on the board, said in a statement in the company press release: “We sincerely thank Greg Swienton for leading Ryder to an improved sustainable business model, significantly enhanced financial performance, and an organization-wide commitment to business integrity.”

Ryder stock dropped 1.5 percent Monday, to $48.81 a share.

7-year-old in critical condition after accident




















Police were investigating an accident involving a 7-year-old who was struck by a vehicle in a Lauderhill neighborhood late Saturday, Lauderhill Police spokesman Rick Rocco said.

The vehicle and its driver, who has not yet been identified, remained on scene after the incident near the intersection of Northwest 27th Court and 56th Avenue.

The child was transported to Broward Health Medical Center in critical condition immediately after the incident, police said.





Details of the accident were not immediately available.

Conn. gunman killed self when he heard first responders coming; police 'confident' they'll be able to 'answer all questions'








NEWTOWN, Conn. — Connecticut's governor says the elementary school gunman committed suicide when he heard first responders coming.

Speaking on ABC's "This Week," Gov. Dannel Malloy said Adam Lanza shot himself as police entered Sandy Hook Elementary School.

Malloy's comments raise the possibility that Lanza had planned an even larger, more gruesome massacre.

Malloy also reiterated that Lanza shot his way into the locked school.

"He used a weapon to open up the glass and then walked in," he said. "He discharged to make an opening and then went through it, went to the first classroom, as you know, went to the second classroom."

"We surmise that it was during the second classroom episode that he heard responders coming and apparently at that, decided to take his own life," Malloy said.

Malloy offered no possible motive for the shooting and a law enforcement official has said police have found no letters or diaries left behind that could shed light on it.

Later this morning, Connecticut state police Lt. Paul Vance told members of the media he was "confident" that police will be able to "answer every question possible" after their investigation is complete.

He added that the bodies of the victims are already being released to their parents.

A funeral for one of the children, 6-year-old Noah Pozner, is being planned for Monday.

Vance also said he hopes the Connecticut state police will be able to provide full information later this afternoon on the last two fatal victims of Lanza's rampage, noting that the shooter had four firearms with him, one more than the number of weapons he was originally believed to have.

Newtown police Lt. George Sinko said that school officials will determine what happens but that he thinks it will be very difficult for the children to return to Sandy Hook Elementary in Newtown.

But he says authorities want to keep the children together because the survivors "need to support each other."

Vance also took a harsh tone towards people pretending to be the shooter or otherwise spreading misinformation, including threatening and inaccurate details, about the case on social media.

Anyone perpetrating misinformation on social media "could be arrested and prosecuted under federal law," Vance said.

Miami in spotlight at AVCC, other entrepreneurship events




















Entrepreneurs from around the world took the stage during this packed week of entrepreneurship events in Miami: Florida International University’s Americas Venture Capital Conference (known as AVCC), HackDay, Wayra’s Global DemoDay and Endeavor’s International Selection Panel.

The events, all part of the first Innovate MIA week, also put the spotlight on Miami as it continues to try to develop into a technology hub for the Americas.

“While I like art, I absolutely love what is happening today... The time has come to become a tech hub in Miami,” said Miami-Dade Mayor Carlos A. Gimenez, who kicked off the venture capital conference on Thursday. He told the audience of 450 investors and entrepreneurs about the county’s $1 million investment in the Launch Pad Tech Accelerator in downtown Miami.





“I have no doubt that this gathering today will produce new ideas and new business ventures that will put our community on a fast track to becoming a center for innovative, tech-driven entrepreneurship,” Gimenez said.

Brad Feld, an early-stage investor and a founder of TechStars, cautioned that won’t happen overnight. Building a startup community can take five, 10, even 15 years, and those leading the effort, who should be entrepreneurs themselves, need to take the long-term view, he told the audience via video. “You can create very powerful entrepreneurial ecosystems in any city... I’ve spent some time in Miami, I think you are off to a great start.”

Throughout the two-day AVCC at the JW Brickell Marriott, as well as the Endeavor and Wayra events, entrepreneurs from around the world pitched their companies, hoping to persuade investors to part with some of their green.

And in some cases, the entrepreneurs could win money, too. During the venture capital conference, 29 companies —including eight from South Florida such as itMD, which connects doctors, patients and imaging facilities to facilitate easy access of records — competed for more than $50,000 in cash and prizes through short “elevator’’ pitches. Each took questions from the judges, then demoed their products or services in the conference “Hot Zone,” a room adjoining the ballroom. Some companies like oLyfe, a platform to organize what people share online, are hoping to raise funds for expansion into Latin America. Others like Ideame, a trilingual crowdfunding platform, were laser focused on pan-Latin American opportunities.

Winning the grand prize of $15,000 in cash and art was Trapezoid Digital Security of Miami, which provides hardware-based security solutions for enterprise and cloud environments. Fotopigeon of Tampa, a photo-sharing and printing service targeting the military and prison niches, scored two prizes.

The conference offered opportunities to hear formal presentations on current trends — among them the surge of start-ups in Brazil; the importance of mobile apps and overheated company valuations — and informal opportunities to connect with fellow entrepreneurs.

Speakers included Gaston Legorburu of SapientNitro, Albert Santalo of CareCloud and Juan Diego Calle of .Co Internet, all South Florida entrepreneurs. Jerry Haar, executive director of FIU’s Pino Global Entrepreneurship Center, which produced the conference with a host of sponsors, said the organizers worked hard to make the conference relevant to both the local and Latin American audience, with panels on funding and recruiting for startups, for instance.
